Teacher meets a middle school student with mental disability for sex

An elementary school teacher was arrested for having sex with a middle school student with a mental disability. 

The 30-year-old male teacher has been charged with sexual assault of a minor with a disability and is being investigated further. 

It is reported that the teacher met the middle school student, a 13-year-old girl, through a random chat website; they met up several times for sex back in May and June earlier this year.

The 13-year-old posted, "I am looking for a boyfriend," and the teacher responded to the post according to the police report.

The disturbing incident came to light when the student confessed everything to her school counselor, who then contacted the police. The teacher has admitted to having had a sexual relationship with the girl. 

The police are investigating whether the 13-year-old, who suffers from mental developmental issues, can be considered to have the capacity to consent to sex. In South Korea, the age of consent is 13.

thats crazy.... you gotta be 19 to be responsible enough to drink... but they think kids at the age of 13 can handle having sex???  sex causes a whirlwind of emotions, fears, and thoughts that kids that age can't handle... adults can barely handle them!!  ummmmmm.... did i miss something here??

I heard 'age of consent' mentioned A LOT this year due the Korean's entertainment industry's casting of female minors with adult male actors. (Age of Majority in Korea is 19 so that means you're still considered a minor until 19) MANY KOREANS were outraged as these money grubbing producers and parents used 'age of consent' as an excuse to push their kids (a la Lindsay Lohan) into adult roles and to also test viewers limits. Hopefully, we can all agree that just because something is legal doesn't make it necessarily right. It's my understanding that this law is decided case by case so this sicko should get the maximum penalty!

The sad part is even though the age of majority is 19, the age of sexual consent in Korea is 13. Hence, there are many cases in Korea where the offender and juvenile defendant have consensual sex, the offender is ruled as not guilty in criminal court, but guilty in the supreme court. I just think Korea needs to revise their law...

regardless of how old the girl is, because of her condition (so it seems) and his position as a teacher it's still rape. Also I think it's kinda funny how people are making a fuss over whether the age limit is too low or not... it should depend on the situation. In some cases there clearly is sexual exploitation going on, in other cases it's just a 15 year old with a 13 year old bf/gf.

Even if the boyfriend is 13/2 years I still feel 13 years is far too young for anyone to be having a sexual relationship. You're not ready mentally.

Most people aren't at 13... and many aren't ready when they're 25... at the same time.. some actually are ready at 13. Like I said, age of consent is according to the individual and should be judged as such, having a law dictate when someone is or isn't ready ignores the actual problem and creates new ones. In this case it's clearly rape, regardless of age, but in other cases where it is considered statutory rape, it's just 2 people having a relationship (and sometimes even, a younger person exploiting their age to blackmail an older person).

Having it as low as 13 leaves many people open to exploitation. Of course having an age of consent won't completely fix such problems, but It'd sure make a positive difference if it were raised to a non pedophilic age.

But the problem is that the law defines what that is... You're a pedophile when you're 18 and you have a sexual relationship when your partner is 16 in some countries. At the same time it's okay according to the law to be 80 and be in a sexual relationship with a 20 year old.. Also, the notion that it is somehow easier to take advantage of people if the age limit is low should not be the case either. I'm not sure whether or not it is in SK (I actually think it doesn't really matter, rape is rape, and it seems it's always more or less treated the same way. Perps always seem to get off way too lightly on these things in SK). Perhaps it would help if people would get rid of the whole age of consent thing and change it to take into consideration age difference and absolute age and circumstance of when the potential crime happened. Like... if the age difference is only a few years and the younger person was 13 at the time then it shouldn't automatically be considered statutory rape compared to a guy who's 30 who does something with a girl who is only 13 (assuming their circumstances are otherwise similar). Age of consent as it is used now just doesn't make sense, most crimes have different levels of punishment according to the severity of the same crime, why doesn't the same apply to age of consent? As if you get the same punishment for multi-million fraud and forging a check.

I don't know how it works in SK, but here crimes that fall under statutory rape are tried on a case by case basis. Like you say, it would be ridiculous for a boyfriend of a 2 year age difference to get the same punishment as a 50 year old. But I do feel friends/family members should have to ability to flag up an underage person in a sexual relationship with the authorities, in case she is being abused or exploited. Without there being a minimum age we'd be totally powerless to protect young people we were concerned about.

I agree with you, but I also think age of consent is not the way to make sure young people aren't exploited, age of consent also does nothing to protect those older than that age from the exact same crimes. I think if a family thinks their child is being exploited then it should be possible for them to raise the issue with authorities regardless of their age. For instance, if a person has a mental disability or is otherwise judgmentally impaired (through the use of medication or drugs or whatever, or even because they haven't developed mentally enough i.e. their mentally too young) it should be possible to prove that whoever is having those sexual relations with such people should be punishable for it. All this can be done without having to resort to such blanket regulations as an "age of consent", which, in my eyes, only creates a maze of exceptions and irregular cases. Not to mention human sexual exploitation in the form of forced prostitution and trafficking and what not.

It shouldn't be legal. Speaking for myself when I was 14 and men in their 20s/30s hit on me it felt empowering and made me feel like I was all grown up and mature. Now 6 years later when I think about it it makes me sick.

Thing is... the concept of "age of consent" in the law is faulty to begin with. Some people who are 13 are ready, and some people who are 30 are not. It really depends on the individual and their situation whether or not something is actual rape... there's so many cases where an otherwise normal couple (i.e. 2 or 3 years difference) are torn apart because one of them is on the wrong side of the age limit and the parents of the one who is younger don't agree with their relationship. Or cases where the younger person takes advantage of the older person by blackmailing them using their age. This particular case is wrong, not because she's 13, but because everything else here points towards that guy taking advantage of her.

I've read stories how a high school student was thrown in jail and missed out on a full scholarship for college because he had sex with his GF, or how a high school student was able to blackmail a mentally disabled man into paying her thousands of dollars because she threatened to tell the cops about how they did all these dirty things together... Age of consent really is a fucked up rule.
