The agency of FIFTY FIFTY, ATTRAKT, has lost its appeal in the ongoing copyright dispute over the group’s hit song “Cupid.”
On March 5, Civil Division 5-2 of the Seoul Central District Court dismissed ATTRAKT's appeal in its lawsuit against The Givers, led by CEO Ahn Sung Il, seeking confirmation of copyright ownership.
The court ruled, “According to the copyright transfer agreement, the contractual party is The Givers. It is difficult to conclude that the rights to each copyrighted work acquired under their service contracts were obtained on behalf of ATTRAKT.”
In response to the appellate ruling, ATTRAKT stated, “Under the service agreement, The Givers was obligated to report all matters related to the FIFTY FIFTY project to the principal, ATTRAKT. However, they secretly purchased the copyright without reporting it and later submitted false reports. They failed to fulfill their duty as a service provider to maximize the principal’s interests. This is a result that is difficult to accept.”
The agency added that it will determine its next course of action after consulting with its legal representatives.
Previously, in 2024, ATTRAKT filed a lawsuit demanding the transfer of the “Cupid” copyright property rights held by The Givers. Copyright property rights allow for the commercial use of music or the authorization of its use by third parties.
Meanwhile, in January, ATTRAKT partially won a separate damages lawsuit it filed against The Givers.
