The 600 million KRW (approx. 430,837 USD) civil lawsuit between EXO members Chen, Baekhyun, and Xiumin (ChenBaekXi) and SM Entertainment over exclusive contracts will enter court mediation.
According to a September 22 legal community report, back on September 1, the 15th Civil Division of the Seoul Eastern District Court referred SM Entertainment's lawsuit for contract enforcement, along with ChenBaekXi's countersuit, to mediation.
The first mediation session will take place on the 23rd at 2:45 PM KST at the Seoul Eastern District Court.
Previously, in June last year, SM Entertainment filed a lawsuit against the ChenBaekXi members, arguing that "the exclusive contracts are still valid." At the time, the complaint reportedly stated that "SM can no longer tolerate ChenBaekXi’s unreasonable behavior."
ChenBaekXi responded with a countersuit, claiming they had "not been properly provided with settlement documents." Through their agency INB100, they argued that "SM failed to uphold its promised 5.5% distribution fee rate for albums and music," and further contended that the agreement requiring them to pay 10% of their individual earnings was unfair.
