Arrest warrant dismissed for Hara's ex-boyfriend Choi

Hara
An arrest warrant for Choi Jong Bum has been dismissed. 

On October 24, Seoul Central District Court announced the arrest warrant for Hara's ex-boyfriend has been dropped. The judge stated, "There is no condition showing the photos and videos were leaked to a third person. Also, it's difficult to accept the reason and the necessity to arrest the suspect when just considering the criminal facts alone."


Back on the 19th, the police submitted an arrest warrant request for Choi. Choi attended investigation of the warrant around 10:15 am on the 24th. The investigation continues.

I am NOT sure that the PROSECUTOR or JUDGE really WANT a CRIMINAL TRIAL in this HARA vs. ex-BF CHOI situation. It is a 'domestic squabble' situation, in the end. One that got 'out of hand' in terms of their 'parting' behavior toward each other. I still think that CHOI is at fault FAR MORE than HARA is. But MAYBE this 'Failed Arrest Warrant' allows the PROSECUTOR to CLAIM that they tried to bring a CRIMINAL case, and FAILED at it. When MAYBE the PROSECUTOR did NOT want the CRIMINAL TRIAL of CHOI much anyway.

You are absolutely right there. First of all, in many Countries, DM violence cases that will go to court are

rare, especially in Asian, Africa, South America etc. Often the victim needs to be really hurt to point of bedridden, or there are already repeated reports of Domestic Violence by victim recorded by Police.

Secondly, you made a very interesting point. Sometimes to please the public, the prosecutor need to be seen taking action but reality is, the court may not act on it. But at least the prosecutors have done their jobs. It is all a show. Just like Politics.

Good point. Dahee and Ji yeon both got sentenced to a year in prison for blackmail, but this guy assaults and blackmails Hara and it looks like it's going to get dismissed as a domestic incident. No justice for women in Korea.

"...It's difficult to accept the reason and the necessity to arrest the suspect when just considering the 'criminal' facts alone!" I'm not familiar with due process of Korean law but the criminal facts are usually what a warrant is based on. Then, during a trial, or the plea bargain, other circumstances are brought up and can be considered during sentencing, if it gets that far! Technically, he could be arrested, processed, and then released without bond pending a trial. I guess my point is, if a warrant can't be issued on the criminal facts, what is it issued on?

Wait ... Let's go over this real quick. Something doesn't make sense.


Korea ARRESTED Kim DaHee for a year and on top of that, giving her COMMUNITY SERVICE work for 6-12 months for blackmailing a MAN who was mentally abusing her best friend back in 2014.

But Choi BLACKMAILED (proof/evidence has been exposed) Hara, yet the court let him go !?

Oh ! But that's not all ...

Hara gets CHARGED for causing a few scratches on Choi's face (she admitted she did it, SELF-DEFENSE). But Choi didn't get charged for DESTROYING Hara body ? ... They completely IGNORED that. The law (man) in Korea always takes the sides of MAN. Fans, citizens are on Hara's side yet they do nothing to save her !

In America, fans/citizens CHANGE history when Justice isn't being handle right. I'm so upset bro.

I am *sympathetic* to your viewpoints. But also, IF you cannot WIN the case, then for the PROSECUTOR to bring a TRIAL on it, is a MONEY EXPENSIVE waste of everyone's time. And it is beginning to appear that the COURT is preferring to see this HARA vs. ex-BF CHOI matter 'solved' in an 'Out of Court' settlement manner. Which actually, that is what HARA did want it from the very beginning.

"Considering the criminal FACTS alone" tells us that there are indeed some truth with proof to Hara's claims of abuse and intent to distribute the video BUT since he DIDN'T actually send the video to any one, we don't see the need to apprehend and detain the abuser because we don't feel that physically abusing or mentally abusing a women is an important reason to make an arrest at this time. THAT IS HOW THEY SHOULD HAVE WRITTEN THEIR STATEMENT because this is exactly what they are telling women. A man can do these things but its' not at the expense of losing your life so the law isn't going to do anything but get back to us when he almost kills you...Then we will think about it.

MAYBE this is the COURT manner of 'signaling' to ex-BF CHOI, that the POLICE think that HE is more AT FAULT than HARA in their situation. Which, maybe this means that CHOI is supposed to get the 'idea' (notion) that to SETTLE this in an 'Out of Court' manner with HARA would be BEST for the BOTH of them. Which is what HARA wanted to do it (Out of Court) from the beginning.

The police have no power in Korea. The police wanted him arrested but the prosecutor chose not to have him arrested. The prosecutor's office is who is powerful in Korea, not the police. They didn't think an investigation was warranted since both of them had physical injuries. Never mind she did it to protect herself, they just aren't interested.
