
According to media outlet reports on May 8 KST, the 62nd civil division of the Seoul Central District Court has rejected the intellectual property rights claim lawsuit filed by management company ATTRAKT against the production company, The Givers.
Previously, ATTRAKT filed an intellectual property rights claim lawsuit against The Givers over the song "Cupid" sung by FIFTY FIFTY, problematizing the fact that the legally recognized creator of the song, The Givers, exclusively possessed all rights to use the song for commercial purposes and earn a profit from those commercial uses.
The court concluded that the intellectual property rights of "Cupid" belonged exclusively to The Givers, including the right to offer other parties permission to use or perform the song. While ATTRAKT attempted to make its case by claiming that the song was "jointly created by The Givers and ATTRAKT", the court dismissed the claims, recognizing that The Givers singlehandedly purchased the song from its original composers for global distribution.
This means that ATTRAKT has lost any claims to the song "Cupid", and its girl group FIFTY FIFTY, re-created with original member Keena and 4 new members, will not be able to re-record a new version of "Cupid".
