H.O.T announces to have strong action against SM's former CEO


The company organizing H.O.T.'s concert rebutted CEO Kim's stance on trademark copyright infringement.

On July 2, via the official stance, Salt Innovation - the concert organizer of group High-five of Teenagers said, "If Mr. 'K' (former CEO Kim Kyung Wook) still excuses with false content, and hinders the organization of the concert, we will strongly respond to this issue."

Regarding High-five of Teenagers' concert scheduled to be held in September, Salt Innovation stressed, "We will not use the trademark that is in dispute with Mr. "K" (former CEO Kim Kyung Wook)."

Besides, the company also added, "Mr. 'K' is still making a stance like he has the right to not allow the members to use the 'High-Five Of Teenagers' trademark. From our company's point of view, it's hard to understand Mr. 'K''s implication."

The 2nd concert with the full lineup of "High-five of Teenagers" will be held on September 20-22 at Gocheok Sky Dome, Seoul.

◆ Salt Innovation's full stance is as follows.

From October 13-14, 2018, Moon Heejoon, Jang Woohyuk, Tony An, Kangta, and Lee Jaewon held a concert called "2018 Forever High-five Of Teenagers" after 17 years as a gift for fans who have waited for the group.

At that time, we tried to conduct a concert with the group name, but in order to prevent legal dispute with Mr. "K" who claims to be a trademark owner, we carried out the concert with the concert title. In addition, at the concert of Moon Heejoon, Jang Woohyuk, Tony An, Kangta, Lee Jaewon expected to be held in September 2019, we will not use the trademark that is in dispute with Mr. "K" - who claims to be the trademark owner.

Regarding the concert title "High-Five Of Teenagers" of Moon Heejoon, Jang Woohyuk, Tony An, Kangta and Lee Jaewon, Mr. "K" is expressing his opinion through his legal representative in the interview with the media that not only the logo, the group name but also the official name of the concert -"High-Five Of Teenagers" is also in the process of litigation.

According to the aforementioned interview, Mr. "K" mentioned that the use of the name "High-five Of Teenagers" is an act of violating "K"'s trademark rights, at the same time our company is preparing the concert in the status of violating Mr. K's trademark rights. However, if Mr. "K" enforces rights regarding the trademark "High-five Of Teenagers", he has to receive trademark registration with this name. However, the trademark registration that Mr. 'K' performed with "High-five Of Teenagers" has been denied by the Korean Intellectual Property Office due to concerns that the group members' human rights are violated. In particular, the Korean Intellectual Property Office has proposed the idea that, ""If Mr. 'K' wants to register for the 'High-five Of Teenagers' trademark, then it must be agreed by each member." Even in this situation, Mr. 'K' is still making a stance like he has the right to not allow the members to use the 'High-Five Of Teenagers' trademark. From our company's point of view, it's hard to understand Mr. 'K''s implication."

Additionally, in 2018, after the name of the concert was confirmed as "High-Five Of Teenagers", Mr. "K" conducted a trademark registration on September 18, 2018 just before the concert. When looking at Mr. "K"'s trademark registration date, we cannot help but be suspicious of his intention.

After considering this matter, the concert organization company, Moon Heejoon, Jang Woohyuk, Tony An, Kangta, Lee Jaewon and all staff who prepare the concert received external consultation to avoid arising legal dispute regarding the trademark and we are carefully preparing the concert. If Mr. "K" still uses false information as excuses and hinders the concert organization, we will have a tough countermeasure regarding this matter.

We promise to wait until the day of meeting fans through the concert of Moon Heejoon, Jang Woohyuk, Tony An, Kangta and Lee Jaewon as well as preparing a higher quality concert to meet you.
