Lawmaker proposes 'FIFTY FIFTY Act' to safeguard rights of small and medium-sized agencies in K-pop industry

On December 14 KST, Ha Tae Kyung, a Korean lawmaker, introduced a revised bill known as the 'FIFTY FIFTY Act' to protect the rights and interests of small and medium-sized agencies while establishing a fair trade order within the popular culture and arts sector. The scope of this bill encompasses businesses in the pop culture and arts industry and aims to provide equal support from the government to small and medium-sized agencies.

The proposed amendment acknowledges that current laws and systems predominantly focus on safeguarding singers under agencies, particularly addressing issues such as "singer poaching" and "tampering" (where third parties illegally and unfairly contact entertainers under an agency to influence their contracts). It aims to rectify the lack of legal mechanisms to protect agencies from external threats.

The K-pop group FIFTY FIFTY, which made its debut in November last year and released the hit song "Cupid" this year, achieved remarkable success in the global music market, including the United States. The song even reached the 17th position on the US Billboard 'Hot 100' chart.

However, on June 23 of this year, ATTRAKT revealed that external forces attempted to poach FIFTY FIFTY members. On June 27, it was disclosed that The Givers, the project manager, deleted project-related materials during the transition process. Consequently, a complaint was filed against The Givers CEO Ahn Seong Il and three others, accusing them of obstructing business and secretly purchasing the copyrights of "Cupid".

Lawmaker Ha emphasized, "K-pop's international prominence is growing, and to further invigorate the industry, balanced development between artists and agencies is essential. We aim to promote the sustainable development of the K-pop industry by protecting not only artists but also agencies."

Jun Hong Jun, CEO of ATTRAKT expressed gratitude for the proposed bill aimed at safeguarding agencies against unfair external interventions, such as poaching or tampering, which are prevalent in the entertainment industry. He hopes that the FIFTY FIFTY Act will create a fair competitive environment, ensuring that the hard work and efforts of small and medium-sized businesses do not go in vain.

Fifty Fifty certainly have left their mark in the industry, for all the wrong reasons in all the wrong ways, and their lasting legacy will be a law(s) that prevents and punishes such behaviour as theirs.

With being sued on top of everything they must be near top of the list for this year’s Dawin’s award.
