Another plea date in the fight between SM Entertainment and former EXO members Luhan and Kris for their contract nullifications took place on October 30 at the Seoul Central District Court.  Was there any progress this time around?

On this day, both sides relayed their desire for the issue to be resolved by a decision from the court.  Kris and Luhan's sides requested SM to submit documents regarding the boys' schedules since their training days.  Their attorney stated, "Because the contract and the execution process of the contract are connected, the contract article needs to be judged. We need to confirm the relationship between the defendant and the plaintiff through the schedule.  They should have it because they had submitted the training schedule during Hangeng's situation, as well."

SM's attorney responded, "We do not exactly understand what kind of document the defendant is speaking about.  We will review [their request] and take measures."

On top of this, the court had especially confirmed multiple times the possibility of their reaching an agreement with both sides relaying that they had no intention to do so. The judge stated, "Is it right for me to deem that the mediation has broken down? The results of this situation would likewise have an effect later on regarding Tao's lawsuit. Is it okay for me to judge that an agreement is not taking place?"

Kris and Luhan's side stated, "Both claims have been confirmed.  The idea suggested by the defendant [SM Entertainment] was to leave the existing contract as is, which is actually advantageous for the defendant.  If they have no intention to modify it, it would be difficult to reach an agreement."

SM simply responded, "We will prepare documents for the preliminary pleading to the effect that the very fact they departed [the group] is wrong."

Meanwhile, SM Entertainment has submitted a lawsuit to the Chinese court stating that until the court makes the final decision regarding the case against Kris and Luhan, the contracts remain in effect, hence they should not be promoting without the company's consent.
