Park Shin Yang Wins Lawsuit But Still Jobless

The verdict is out on Park Shin Yang's legal dispute with production company Victory Production which has been going on for the past few months. The Seoul Central District Court ruled on 8th May that Park Shin Yang's appeal was justified and ordered Lee Kim Productions to fork out 380 million KRW of unpaid wages to the former.

In a nutshell, Park Shin Yang's 2006 SBS drama Money's Warfare had done exceptionally well in the ratings which prompted Lee Kim Productions (sensing more money to be made) to suggest to SBS and Park Shin Yang for an extension. Park Shin Yang agreed and he was paid 170.5million won per extension episode, 4 times the usual payment for the 16 episodes. Everything was written in black and white, but Park Shin Yang did not receive a cent after the conclusion of the drama filming.

Things then erupted in July 2008 as Park Shin Yang sued Lee Kim Productions for unpaid wages. Lee Kim Productions counter-attacked by getting The Korea Television Drama Production Company Association on it's side, berating Park Shin Yang for demanding ridiculous wages in hard times. Park Shin Yang was subsequently banned indefinitely from acting in any more dramas produced by the association's 30 odd members including SamHwa, Kim Jong Hyuk Production Company, Chorokbaem Media, Olive Nine, Pan Entertainment etc. The broadcasting companies like SBS, KBS, MBC, etc were also asked to enforce the ban on Park Shin Yang. After finishing SBS Painter of the Wind last year, Park Shin Yang has been basically "jobless".

The Seoul Central District Court had ruled that, "Even though the fees stated in the contract signed by both parties were kind of excessive, there were no grounds to dismiss the contract because of that. We have thus decided that the terms in the contract should be abided to legally and Lee Kim Productions must fork out the unpaid wages to Park Shin Yang." Sadly for Park Shin Yang, even though he was won the legal battle and got back the money he deserved, the indefinite ban imposed on him by The Korea Television Drama Production Company Association still stands. Hopefully, the ban will be lifted soon, otherwise we will be missing out on a great acting talent.

I think it is unfair for Park Shin Yang to be treated this way!!!
He just demanded what was due.. it was not his suggestion to be paid this way.. the production company was the one who initiated the offer. Even if it is true that the pay is quite excessive, they should stick to their word and not use the financial crisis as an excuse to bail themselves out from paying the salary..
The drama association also sucks for supporting this!
I hope they can work things out soon or else the industry will lose one of the best actors out there!!!

Well that is just ridiculous they pay him nothing, they signed a contract and that was 2006 they need to abide by it. Hope he cand find work in the States or Japan. I know times are rough but very many people work for free especially when the production company made really good money and is using it as an excuse not to pay him for three years.

He probablly had another job he could have taken or considered so he lost money when they did there last minute extension.

They make the agreement in 2006, before the crisis…
The company should pay him at that time. It may sound big in 2008 but they make a deal in 2006 and the company already get their big money at that time…                             
Stupid, greedy company.
They just refuse to pay it, crisis is not the reason why they are not paying it.

what’s the point of a contract, if you ain’t going to abide to it? if the tables were turned, they would have taken all his money and more…and then probably banned him too…

If they think that the fee was excessive then why’d they sign the contract? If they agreed to that sum of money then HE’S the one who is right in this situation. Park Shin Yang is a wonderful actor and its a shame that he’s wont be doing any projects for a while.

if they thought the fee was high why did they agreed to pay him that?
Park Shin Yang has the right to claim for his payment… afterall, he did his part of the contract, he worked but the production company didn’t fulfilled their part which was to pay him for his work.
And why on earth are they complaining about Park Shin Yang… one of the reasons ‘Money’s War’ was sucessful was because of Park Shin Yang’s amazing portrayel of Geum Nara,
I hope the korean channels stop banning him because Park Shin Yang is a wonderful actor.

dude, its the broadcasters fault for getting greedy and making a deal that couldnt be met. u cant blame recession for this kind of thing..and to make everyone else turn their backs? haha..tsktsk!
w/e i dont really know the case but they were both kinda wrong but shouldnt something be done? instead of only talking about it

I’m so glad that this lawsuit panned out… But it probably cost PSY more than is fair. I hope Lee Kim Productions pays all those court fees because it was definitely an idiotic move on their part not to abide by the contract. They need to hire some new people to draw up those contracts from now on… preferably one who knows the meaning of the word CONTRACT… aka legally binding.

If they can do whatever the hell they want… why draw up a fucking contract at all. Just an example of how lesser known actors/actresses can and probably do get screwed over. Imagine what they do to D listers when they try to pull this kind of crap on an A/B lister.

Its about time, is so clear because he has legal contract papers with signatures from both parties so he should get what was agreed upon.  Although it is sad that he ban from tv right now hopefully in the future he will come back, they are letting a great actor pass by. PSY Fighting!!!

What kind of bullshyt is that? You agree to pay someone a certain fee for their services and when they ask for their money you say “I can’t believe you still expect us to pay you that right now”. That’s not professional at all.

I can’t believe those companies have publicly agree to ban him for no good reason. Isn’t that a form of collusion? Couldn’t he sue over that too?

okay, im kind of glad he won the lawsuit…but he should show some compassion as a human being and been gracious enough to lower his asking fee on the contract…it’s a matter of character really.  korean people really scrutinize celebs on that kind of stuff.  oh well, im not a huge fan of his so it doesn’t bother me.

Yea seriously his company is sprouting such bs. They claim he’s claiming too much money in hard times? Um not like they gave that money to their employees or helped the world with the money… It was in the contract and yet they just said op times have changed so forget your payment? lol… no.

So glad PSY won!  The ban is ridiculous to begin with and these people keep deframing him since then saying he asked for too much and is not willing to lower the fee etc.  Taking legal actions against those who don’t pay up has nothing to do with someone’s character.

He didn’t get his contracted wage since way back before the financial dump happened.  This prod company had planned not to pay him then.  How could he not sue them.

And I agree with @29 - if they can do this to an A-lister, what will they do to those that are not up there.  This lawsuit is not only financial, but also symbolic.  I am glad the Court gave this clear verdict.

Do these people even know the meaning of a contract?  I’m glad at least the court does.  It’s just all unfair to Park.  I don’t even see how the association even find a valid reason to ban him.  Yes, the economy is in a crisis, and yes, it’s a big amount of money; but this contract was before the crisis and this is the amount agreed by BOTH parties in a contract ~ if one party didn’t agree—don’t sign it.

to 37. Im not a fan of his either. In fact, I never like romance in Paris or whatever the title, but what do u mean by compassion? These companies are businesses. You see many times companies abuse their power a.k.a “the ban”. Do they show compassion to him? They earn profit out of the drama, they should fork up the money. They draw up contracts, but dont want to fulfill them. They allied together and try to suppress/ threaten the guy so they can have their way. Even if the amount is ridiculous, they should have said something. But they accept the amount because they think they can get by and not paying. I dont think there’s anything wrong for juicing out money from big business? This lawsuit also say alot about the characters of the people behind these companies. And i think their characters are worst than saying PSY is greedy.
