Choi Jin Shil's defamers gets light sentence

The Seoul Central District Court had ruled recently on 16th June that the 2 securities company staff who allegedly contributed to actress Choi Jin Shil’s death by posting vicious online rumors about her, will have to serve 120 hours of community service as punishment.

In the aftermath of Ahn Jae Hwan's suicide last September, the 2 securities company staff had posted online rumors that Choi Jin Shil was linked to loan sharks and had lent billions of won to the former, and ultimately causing Ahn to commit suicide. The fake rumors became a source of great burden to Choi Jin Shil, with many netizens falling for the rumor and actually believing it to be true. This was widely believed to be the main motive for her commiting suicide later on.

The Seoul Central District Court ruled that the 2 securities company staff were guilty of defaming one's name and under the cyber defamation law recently passed, the man (35) and woman (known as Baek) were sentenced to 2 years probation and ordered to serve 120 hours of community service. Their sentence will begin this October.

One of the defamers, Baek

The judge in charge of the case expressed, "Although the 2 of them claimed they had no idea that they were spreading rumors, and had no intention of defaming anyone, we felt that they already knew that it was just rumors and were actually working together to spread the news. We thus decide to sentence them based on the legal constitution."

Only 120 hours of community service? Sad case indeed.

*Only 120 hours of community service? Sad case indeed.*

well they were exposed and ppl probably know about them now. with the added 120 hrs com serv. it should be tough enough

anymore might even make even them want to commit suicide. so i think its the right amount of punishment

kinella's avatar

WTF!!
she got sued for being a domestic victim after her death, and those awful humans who lead her to suicide won’t have to pay not even a cent for causing her death and leave 2 kids orphans?

we really live in a rotten planet

alice_inwonderland's avatar

that’s ridiculous.
how could it only be 120 hours when they were the indirect push that lead her to suicide? there should have been some harder punishments to warn and act as a means to deter others away from committing the same crap in the future.
sigh >>”

That’s so messed up….Like that American mom who pretended to be a teenager to send one of her kids’ classmates to commit suicide as well.

WTF ?!!!!
120 hours of community service , that’s all ? This is nonsense !
I love Korea and all , but their sense of justice is just CRAP !!

sks020's avatar

Their laws definitely needs to be changed. Not too long ago a judge ruled in favor of a company who sued Choi Jin Shil for allegedly ruining the company’s image because she was being beaten by her husband.. and now this?! I don’t expect the offenders to spend their lifetime in prison but I was hoping that they would serve some time in jail just to set their minds straight and to serve as a warning to other netizens to not just randomly post rumors about anyone without confirming the truth. I hope the two people who was responsible for posting the rumors against Choi Jin Shil would spend the rest of their lives in guilt for causing the death of a good person and letting two children live without a mother.

dats stupid.. if u have nothing good to say then dont say it in the first place.

Wonderful_WGM's avatar

OMG~ That’s no fair!!! They should get up to 5 years or so years. In the US they’d probably get up to 10 years or something

chibizel41's avatar

120 hours? and it feels like they are the one who killed her! -_____- ugggh!

I know Suicide is not the way and I hate it when people commit it but I feel for this woman. She had all these rumours plus her husband beating up on her, I would have cracked too. She simply didn’t see another way out. I feel sorry for her and her children.

taeyangsexi's avatar

OK this is just SCREWED UP they let a LOSER COMPANY WITH NO MORALS AND WHO IS HEARTLESS sit there and SUE a DEAD women and basically SNATCHING the money right from under her kids because she was beat by her WASTE OF A HUSBAND BUT these 2 IDIOTS sat there and basically COMMITTED murderer whether it was intentional or not still COMMITTED MURDER and they have COMMUNITY SERVICE WHAT THE HECK ARE U KIDDING ME THATS JUST SOO FOUL AND WRONG I WANT TO SMACK THAT JUDGE HOPEFULLY IT WILL GET HIS MIND STRAIGHT

Knick Knacks's avatar

I know it’s a crime that eventually lead to suicide. But that aside, what they did was actually “worth” that small of a punishment in Korea. But assuming that #50’s statement is true (which I think it is), the legal punishment should last longer, and should include jail.

ReiraLee's avatar

...wow…

thats…lame.

Beanii's avatar

I’m sorry but i think Sentencing Them is ridiculous.
The girl commiting suicide Was of her own accord, No one told her to go commit suicide.
Sadly i hate to break it to you, but shes a Celebrity, and *SHOCK* Rumors get spread about celebrities. HONESTLY Allkpop does it too, i guess they should be sentenced For “Cyber Assault”.

I think Korea needs to open more Therapy Facilities, and One of the requirements for becoming a Celebrity is Having a strong Mind and finding Healthy ways to deal with depression.

KarenBooxD's avatar

only 120 hours??

Daikirai's avatar

Wow.  I didn’t know you could be charged for that.. well, it is Korea, and not the US.

vmoo's avatar

WTF! she died, and she got beat by her husband and they let her get sued?
Her kids doesn’t even get to see her anymore because she’s dead.
this is just stupid! >_< stupid judge!

Poor late CJS’s children & family! They had to learn that her suicide was started with a false rumour. Korean netizens are known to be very harsh, mean & rude! What I don’t understand is the judge & judicial system to put such a light sentence to those evildoers, not too mention making her kids to pay 3Million won to the construction company! Simply.. Unbelievably.. Horrendous!! May she rests in peace..

janne5000's avatar

how could they not know ... seriously ?!? they caused someone to kill herself because of a stupid rumor they “didn’t” intend to spread ?!? seriously, how ignorant can they be?

DoubleAAbatteries's avatar

I think they should get more than 120 hours of service…Like 5 years in jail!RIP Choi Jin Shil

Alot of people say that fans bashing doesnt lead to celeb suicide but I think it does. Not only was she suffering at the hand of her husband but also from anit fans too. I’m mad that the company would even dream of sueing her after death. Can they even call themselves human?

no avatar

120 hours of community service?! why not behind bars..

$Dsherrane's avatar

thats bullshiatsu. a person died because of them and their words. justice anyone?

gabz115's avatar

are you serious?!?!
i can do 120 community service hours in my sleep.  In my school, we are required to do 20 community service hours before we graduate.  Most students here have 200 hours already and it did not even take that much sweat!!!!!!

I think she deserves a more harsh punishment ><

no avatar

What?! Life sentence!

WoAiNiHaru's avatar

This is TERRIBLE. That beautiful woman killed herself because of this, and all that happens in 120 hours of community service !?

humorFool's avatar

That is not a good enough punishment, in my opinion. D:

no avatar

wow they didn’t know they were spreading rumors??!?! if you say something and you’re not 100% sure its right thats spreading rumors! ugh stupid people. they are getting off easy! if i were the judge i’d give them soooo much more. jin shil was such a good actress. her talents have gone to waste now. they basically pointed the gun or tied the noose for her.

harman101's avatar

omg, that’s their punishment
