Choi Jin Shil's defamers gets light sentence

The Seoul Central District Court had ruled recently on 16th June that the 2 securities company staff who allegedly contributed to actress Choi Jin Shil’s death by posting vicious online rumors about her, will have to serve 120 hours of community service as punishment.

In the aftermath of Ahn Jae Hwan's suicide last September, the 2 securities company staff had posted online rumors that Choi Jin Shil was linked to loan sharks and had lent billions of won to the former, and ultimately causing Ahn to commit suicide. The fake rumors became a source of great burden to Choi Jin Shil, with many netizens falling for the rumor and actually believing it to be true. This was widely believed to be the main motive for her commiting suicide later on.

The Seoul Central District Court ruled that the 2 securities company staff were guilty of defaming one's name and under the cyber defamation law recently passed, the man (35) and woman (known as Baek) were sentenced to 2 years probation and ordered to serve 120 hours of community service. Their sentence will begin this October.

One of the defamers, Baek

The judge in charge of the case expressed, "Although the 2 of them claimed they had no idea that they were spreading rumors, and had no intention of defaming anyone, we felt that they already knew that it was just rumors and were actually working together to spread the news. We thus decide to sentence them based on the legal constitution."

Only 120 hours of community service? Sad case indeed.

Their sentences are unconstitutional and a violation of human rights. Although slander is always a bad thing when we have government monitoring what we say that’s an infringement of freedom of speech. Of course we can’t go around making death threats but we also can’t imprison people for speaking their minds. If we arrest people for slander almost all the people who use the internet would be in jail. Even this two year sentence seems too much for me. Even if they did cause the poor woman to kill herself, suicide was Choi Jin Shil’s choice. Freedom of speech is something we must defend.

Freedom of speech? Making up something and lie about something that’s not true, then go to the extend of accuse the actress as a loan shark is one thing, speaking up and just giving an opinion about how one thinks about something is another thing. The stupid bitch is old enough and should have a brain, she should know that the slander would lead to misery and a lot of commotion for a public figure.Whether she liked this actress or not, she shouldn’t do this with an intention to put the actress in misery. I see such motive from her. Stupid judge, shouldn’t listen to one side and said that she didn’t have motives. What she’s doing is indirect murder. Think about the consequences, people always tend to agree with majority and think that when one person tells such thing, it might not be true, when a lot of people said so, there must be some truth in it. And think about all the consequences this rumor could lead to, every start to bash this actress and gave her a hard time, that might include coworkers too, ended up only a few family members or friends to support her. How could somebody not in distress and feel like living in hell, especially when she had a huge marriage problem already. Sometimes, a person could only take that much, and that leads to the suicide. Don’t tell me that stupid bitch wouldn’t know what consequences that might lead to. So I don’t buy about that she just barely starting some rumors. So that sentence is way too light.
