Choi Jin Shil's defamers gets light sentence

The Seoul Central District Court had ruled recently on 16th June that the 2 securities company staff who allegedly contributed to actress Choi Jin Shil’s death by posting vicious online rumors about her, will have to serve 120 hours of community service as punishment.

In the aftermath of Ahn Jae Hwan's suicide last September, the 2 securities company staff had posted online rumors that Choi Jin Shil was linked to loan sharks and had lent billions of won to the former, and ultimately causing Ahn to commit suicide. The fake rumors became a source of great burden to Choi Jin Shil, with many netizens falling for the rumor and actually believing it to be true. This was widely believed to be the main motive for her commiting suicide later on.

The Seoul Central District Court ruled that the 2 securities company staff were guilty of defaming one's name and under the cyber defamation law recently passed, the man (35) and woman (known as Baek) were sentenced to 2 years probation and ordered to serve 120 hours of community service. Their sentence will begin this October.

One of the defamers, Baek

The judge in charge of the case expressed, "Although the 2 of them claimed they had no idea that they were spreading rumors, and had no intention of defaming anyone, we felt that they already knew that it was just rumors and were actually working together to spread the news. We thus decide to sentence them based on the legal constitution."

Only 120 hours of community service? Sad case indeed.

wow. a judge agrees to let people SUE choi jin shil for getting beat up by her husband even though she’s DEAD.. and lets the money be taken from her kids.

but a judge lets pretty much a MURDERER go with 120 hours of community service?

where is the justice?

AAAAWWW!!! Wish she didn’t suicide.  Good job, Judge.  Maybe… it might me a LITTLE harsh.  But this proves that YOU DON’T GOSSIP AND BACKSTAB AND RUMOR!!! So stupid!

no avatar

Wow… they get a whole 120 hrs of community service. Were the two suspects male? If so, then it’s just one more case of double standards (male-female) prevalent in Korea. And I’m aware that double standards are present everywhere.

no avatar

O.o
but in the end they did end up killing someone….

Oh my god. That’s nothing.
They should get like 2385724859 years in jail.
Jk not THAT much but certainly more than 120 hours of community service and lame ol’ probation.

jinae711's avatar

that’s not long enough, why would they spread rumors even if they realize they are. >< this is terrible :|

amigo75's avatar

this is quite sad. it doesn’t seem quite like justice whatsoever. horrible, horrible, horrible people do horrible things and good people pay for it.

aimaim_'s avatar

are u kidding me?!
120 hrs of community service?? seriously? that’s it?
wow, that’s so unfair.

no avatar

thats so sad. only 120 hours and 2 years of prison???
when they basically took someones life away

emorella's avatar

they’re basically murderers.
they should go to jail.
sometimes, i think the korean law system is whack.

you go to jail for several years for having an affair.
but you only get probation and 120 hours of community service for basically pushing someone to their death?
that’s stupid.

committing suicide also is PRETTY FUCKING STUPID and RETARDED AS WELL. i dont think the judge has to pity choi jin sil because she COMMITTED SUICIDE. they go by strict constitution. WHEN IN ROME. its in skorea they go by their rules. not urs where ever the fuck u guys live. its just like how koreans find americans stupid for letting cops shoot ppl with those little electricity tazer?? guns and ultimately kill ppl. yet in u.s. its COMPLETELY CONSIDERED ALRIGHT.because the COP DIDN’T KNOW IT WOULD KILL HIM.

coffeeluva's avatar

what the heck these ppl are so unfair. omg. stop making me depressed. >.<

icecreeaamm's avatar

ah >.>” unfair-___-”” spreading rumours, they should know that their intention is to hurt someone which could lead to suicide. so stupid for saying they didn’t know.

moochi's avatar

is this the same judge who agreed to choi jin shil being sued for defaming that whatever brand’s image

cause if it is
this judge needs to quit
seriously…it’s like they don’t give a crap about her life

Certain writers of allkpop like to ridicule certain korean celebrities. Just today someone called Hyo Yeon ugly. If the compilation of all those comments motivates Hyo Yeon to commit suicide, should certain allkpop writers be held partly responsible for that? These two people mentioned in the article spread rumors. As malicious as they must have been, their motive was not murder.

How about the parts that netizens played in fueling the rumors? Does committing suicide automatically guarantee the actress guiltless in her crime against herself? What about the loved ones she cared to leave behind?

Who is really to blame? And how much?

120 HOURS?! Are you kidding me?

I’ve already done 300+ hours of community service just to get out of high school!
And those people are getting 120 hours for basically aiding in suicide?!

baubrey1001's avatar

awww how sad i really want to read up on this.

eunii's avatar

so sad. D: ONLY 120 hrs. of volunteer service. isn’t that being a bit too nice? :/

no avatar

What that’s it? They just got slapped on the wrist for what they did!!
I remember the Baek girl kept calling Jin Shil and threatening her too!!

no avatar

i’m glad those 2 are being punished for they’re actions they deserved more than that. People don’t really realise how much their words affect others. This is sad.

xo_geena's avatar

WTF?! only 120 hours of community service?! that’s completely ridiculous. they should be thrown in jail for what they did.

no avatar

120 hours is hardly enough. =.=

ftLOVE's avatar

well, there is no need to blame anyone~~~it’s sad thougth but they didn’t have any intention to kill…besides, commiting suicide isn’t anything responsible either even if you’re depressed~~ but still R.I.P~~

eumakai's avatar

I think it’s a light sentence because it doesn’t show that you will get heavily punished for defaming somebody…esp in Korean culture…this kind of stuff will lead to suicide.

At the very least we know that netizens know every detail of their life and they probably will be getting threats on their own webpages for a long time to come.

But what about her calling Choi Jin Shil threatening her?  Wasn’t that part of the case O.o

takaraS2taemin's avatar

thats so sad. why would anyone do that to another human being. i hope he gets another sentence after that T.T

no avatar

her life = 120 hrs of community service and 2 years probation??? That just sounds ridiculous. Where is the justice in this story?

no avatar

Maybe this should teach Netizens/antifans to not be so harsh to celebs…...it’s useless and it could hurt you. To tell you the truth, why should people even believe that crap though? Are they really stupid?

But seriously? A girl commits suicide because she was beat up by her husband, her husband doesn’t get much trouble, she’s sued for the money she left for her kids who are still trouble from her death that was caused by a husband who didn’t receive much trouble from his crimes (?), and now some people who contributed (supposedly and very unintentionally but still very hurtful) to her death are now getting off easy. Oh wells. At least from now on getting a job will be really hard for them.

But still….people commit suicide everyday because of peer pressure or rumors. WHAT. THE. FUCK. This is seriously reminding me of the beginning of Boys Over Flowers….....

no avatar

they got off too easy for the criminal case…i wonder if there is going to be a civil case…

CJS’s kids have to pay fees incurred caused by their mother’s suicide…these 2 ppl were determined to be legally responsible for contributing to CJS’s suicide which then led to the fees…these 2 should have to at the very least pay a portion of those fees…120 hrs of community service? that’s nothing….

bee's avatar

thats it?
all the allkpopers know what she looks like already , evil netizens !

miracle_for_you's avatar

the least they could have done is send them to jail for a year or two.

tifatumor's avatar

koreas highest suicide rate is due to net rumors um net bullying and only 120? hours?!!!! no ( work hard ppl were gonna become lawyers!) we gonna show em! that bullying is indirect murder thats like paying some 1 to stab just not touching the blade!!! bloody monkey hell!! yaaaa, was it caz she was just a singer/actor ..if she was a kid of rich person i bet then men would have been hanged, see. this is when i respect yakuza, and mafia families, ” oppa, we gotta do something”...“i know round up the boys, were gonna play a game of who killed jenny!”
