At Patterson's first trial, the court had sentenced Patterson to 20 years in prison and announced, "Due to Patterson's crime, the victim lost his life at a young age and was deprived of his opportunity to enjoy life to the fullest."

Meanwhile, the prosecution stated the reason for their demand, saying, "The defendant is still denying his crime, refusing to reflect on himself, and those who are wronged [in this case] are unable to put their minds at ease," and requested for Seoul High Court to dismiss Patterson's appeal.

Patterson pinpointed the prosecution's abuse of indictment rights as a rebuttal, claiming, "Rather than judge guilt or innocence, [prosecution] is searching for whoever the suspect and criminal is all because this case blew up in Korea. They needed a murderer so they made me the murderer. There is no evidence that I'm the true criminal. I'm innocent," and continued to name Edward Lee, who was also present at the scene of the murder, as the true criminal.

Patterson appealed, "It's a given that the victim's family must be compensated and that their pain must be alleviated; however, those are not good enough reasons to make me the scapegoat. I beseech you in the name of justice, so please help me." Patterson's lawyer added, "We earnestly beg that an innocent person will not end up being punished.

The decision for the appeals trial will be announced on October 13.
